1.Introduction#

This Acceptable Use Policy (“AUP”) describes prohibited uses of the VartaDesk platform and the content, services, and technologies available through it. By using VartaDesk, you agree to comply with this AUP and our Terms of Service.

Violations of this AUP may result in suspension or termination of your account, removal of content, and cooperation with law enforcement as required by law.

2.General Prohibitions#

You may NOT use VartaDesk to:

  • Violate laws or regulations: Engage in any activity that violates local, state, national, or international law, including data protection, privacy, anti-spam, consumer protection, and intellectual property laws.
  • Infringe intellectual property: Upload, transmit, or distribute content that infringes or violates the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of others.
  • Distribute harmful content: Send or promote content that is illegal, harmful, defamatory, harassing, threatening, abusive, hateful, obscene, pornographic, or otherwise objectionable.
  • Engage in fraud or deception: Misrepresent your identity, impersonate others, engage in phishing, scams, pyramid schemes, or any fraudulent or deceptive activity.
  • Distribute malware or harmful code: Transmit viruses, worms, malware, ransomware, or any code designed to harm, disable, or interfere with software, hardware, or networks.
  • Interfere with the Service: Disrupt, damage, or impair the VartaDesk platform or servers, attempt unauthorized access, reverse-engineer the Service, or launch denial-of-service (DoS) attacks.
  • Harvest or scrape data: Use automated tools (e.g., bots, scrapers) to collect data from the Service without authorization.
  • Resell or misuse the Service: Resell, sublicense, or provide access to VartaDesk to third parties without our prior written consent, or use the Service in a manner that competes with VartaDesk.

3.Messaging and Communication Standards#

3.1. Consent and Opt-In Requirements

You must obtain prior express consent from recipients before sending them marketing, promotional, or transactional messages via VartaDesk. Consent must be:

  • Clear and informed: Recipients must understand what they are consenting to (e.g., receiving WhatsApp messages from your business).
  • Documented: You must maintain records of how and when consent was obtained.
  • Revocable: Recipients must be able to opt out or unsubscribe easily at any time, and you must honor opt-out requests promptly.

You are responsible for complying with all applicable opt-in and consent laws, including GDPR (EU), CCPA (California), CAN-SPAM Act (U.S.), TCPA (U.S.), and local regulations in the jurisdictions where you operate.

3.2. No Spam or Unsolicited Messages

You may NOT:

  • Send unsolicited bulk messages (spam) to recipients who have not opted in or consented.
  • Purchase, rent, or use third-party contact lists without verifying that recipients have consented to receive messages from your business.
  • Send misleading or deceptive messages, including fake sender names, subject lines, or content.
  • Fail to provide clear opt-out mechanisms (e.g., unsubscribe links, STOP keywords) in marketing messages.

3.3. Compliance with Messaging Platform Policies

VartaDesk integrates with third-party messaging platforms (e.g., WhatsApp Business Platform via Meta, Twilio for SMS, RCS providers, email providers). You must comply with the terms, policies, and guidelines of these platforms, including but not limited to:

  • WhatsApp Business Policy:Follow Meta's WhatsApp Business Policy and Commerce Policy, including requirements for opt-in, prohibited content categories, and user experience standards. Violations may result in your WhatsApp Business Account being restricted or banned by Meta.
  • SMS and RCS Carrier Guidelines: Comply with carrier-specific rules (e.g., CTIA guidelines in the U.S.) regarding content, consent, and acceptable use.
  • Email Standards: Follow best practices for email deliverability, including SPF/DKIM/DMARC authentication, unsubscribe mechanisms, and anti-spam requirements.

VartaDesk is not responsible for suspensions, bans, or penalties imposed by third-party messaging platforms due to your violations of their policies.

4.Prohibited Content Categories#

You may NOT use VartaDesk to send or promote content related to the following categories (unless you have obtained all required licenses, approvals, and complied with applicable regulations):

  • Illegal goods or services: Drugs, narcotics, controlled substances (without proper licensing), illegal weapons, counterfeit goods, stolen property.
  • Regulated industries: Pharmaceuticals, medical devices, tobacco, alcohol, gambling, financial services (e.g., loans, investment advice), cryptocurrency, adult content — unless you operate in compliance with all applicable laws and platform policies.
  • Harmful or dangerous activities: Self-harm, violence, terrorism, extremism, hate speech, harassment, or content that incites harm.
  • Misleading health claims: False or unverified medical, health, or wellness claims (e.g., miracle cures, unapproved treatments).
  • Exploitative content: Child exploitation, human trafficking, or any content that exploits vulnerable individuals.

If your business operates in a regulated vertical (e.g., healthcare, finance, education), you are responsible for ensuring full compliance with industry-specific regulations and obtaining all necessary consents and disclosures.

5.Data Protection and Privacy#

You agree to:

  • Comply with all applicable data protection and privacy laws (including GDPR, CCPA, and others) in your use of VartaDesk and handling of End User data.
  • Obtain all necessary consents, authorizations, and disclosures before collecting, processing, or sharing personal data.
  • Implement appropriate security measures to protect End User data from unauthorized access, disclosure, or loss.
  • Provide transparent privacy notices to End Users explaining how their data is collected, used, and shared.
  • Honor data subject rights (e.g., access, deletion, correction) as required by law.

6.Account Security and Access#

You are responsible for:

  • Maintaining the confidentiality and security of your VartaDesk account credentials.
  • Restricting access to your account to authorized users only and using role-based access controls (RBAC) where appropriate.
  • Notifying us immediately if you suspect unauthorized access or a security breach.

You may NOT share, sell, or transfer your account credentials, or allow third parties to access your account without authorization.

7.Reporting Violations#

If you become aware of content or activity on VartaDesk that violates this AUP, please report it to us immediately at info@sevendmobility.com. We will investigate reported violations and take appropriate action.

8.Enforcement and Consequences#

We reserve the right to investigate and take action against any user or account that violates this AUP or our Terms of Service. Actions may include:

  • Issuing warnings or requests to cease prohibited activity.
  • Suspending or restricting access to features or the entire platform.
  • Terminating accounts and deleting associated data.
  • Removing or disabling access to prohibited content.
  • Cooperating with law enforcement, regulators, or third-party platforms (e.g., WhatsApp, Twilio) in investigations or legal proceedings.

We are not liable for any damages or losses resulting from enforcement actions taken in accordance with this AUP.

9.Changes to This Policy#

We may update this Acceptable Use Policy from time to time to reflect changes in legal requirements, platform policies, or our practices. The updated policy will be posted on this page with a revised “Last updated” date. Your continued use of VartaDesk after changes become effective constitutes acceptance of the updated policy.
